STATE OF GEORGIA COUNTY OF NEWTON NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT UNDER AND BY VIRTUE of that Power of Sale contained in a certain Deed to Secure Debt from BAYSIDE ESTATES, LLC in favor of THOMAS W. BALLARD, dated November 7, 2023 and recorded at Deed Book 4567, pages 686-692, Public Records, Newton County, Georgia, the undersigned, THOMAS W. BALLARD, as Attorney in Fact for BAYSIDE ESTATES, LLC, will sell at public outcry to the highest bidder for cash before the Courthouse door in Newton County, Georgia, during the legal hours of sale, on the first (1st) Tuesday in June, 2026, namely June 2, 2026, the following described property to-wit: ALL THOSE TWO PARCELS of land lying and being in Newton County, Georgia and being more particularly described as follows: PARCEL ONE: ALL THAT TRACT or parcel of land lying and being in Newton County, Georgia and being that same property as described in that Warranty Deed from Mrs. Annie Maude Morgan to Thomas W. Tax Map and Parcel No. M0010-00000-017-000 PARCEL TWO: ALL THOSE TWO (2) TRACTS or parcels of land lying and being in Newton County, Georgia and being more particularly described as follows: TRACT I: ALL THAT TRACT or parcel of land lying and being in the Town of Mansfield, Newton County, Georgia, and being shown as Lots 17 and 18, H.C. White Subdivision, in accordance with that Plat of Survey recorded at Deed Book 10, Page 217, Public Records of Newton County, Georgia; said plat by reference thereto, being incorporated herein and made a part hereof for a more particular description of said property. TRACT II: ALL THAT TRACT or parcel of land lying in being in the Town of Mansfield, Newton County, Georgia and being the north one half of Lot 16 of the H.C. White Subdivision, as shown on a plat of survey recorded at Deed Book 10, page 217, Public Records of Newton County, Georgia; said plat by reference thereto, being incorporated herein and made a part hereof and being more particularly described as follows: BEGINNING at a point on the westerly right of way line of Main Street (also known as Georgia Highway No. 11) marking the intersection of the northerly line of property now or formerly belonging to Jimmy L. Tax Map and Parcel No. M0010-00000-018-000 The Deed to Secure Debt herein foreclosed securing a Purchase Money Promissory Note dated November 7, 2023, in the original, principal amount of $225,000.00. The debt secured by said Deed to Secure Debt being in default by, among other possible events of default, failure to pay said indebtedness as the same fell due, and the debt secured by said Deed to Secure Debt and evidenced by said Note has been and is hereby declared due and payable in full because of said default. This sale will be made for the purpose of paying the remaining principal indebtedness and accrued interest as accelerated. The proceeds thereof will be applied to the payment of said indebtedness and all charges and expenses in connection with said foreclosure in accordance with the terms of said Deed to Secure Debt and the balance, if any, will be applied as provided by law. Said property will be sold as the property of BAYSIDE ESTATES, LLC, subject to any outstanding and unpaid real estate taxes (ad valorem taxes) or assessments, street improvements, easements, restrictive covenants, and any and all other assessments appearing of record, if any.
