NOTICE OF BOND AND SALES AND USE TAX ELECTION TO THE QUALIFIED VOTERS OF NEWTON COUNTY YOU ARE HEREBY NOTIFIED that on the 21st day of May 2024, an election will be held in all of the precincts of Newton County. At the election there will be submitted to the qualified voters of the Newton County School District (the "Newton District") and Newton County for their determination the question of whether or not $30,000,000 in aggregate principal amount of Newton County School District General Obligation Bonds (the "Newton New Bonds") should be issued by the Newton District for the purpose of providing funds to pay a portion of the costs of the capital outlay projects described in clause (1)(a) set forth below, to pay capitalized interest incident thereto, and to pay expenses incident to accomplishing the foregoing, and, in order to raise funds to pay a portion of the debt service on such bonds and the remaining costs of such capital outlay projects and to raise funds for the purposes set forth in clauses (1)(b) and (2) below, a one percent sales and use tax for educational purposes of the Newton District and the School District of the City of Social Circle (the "Social Circle District") should be reimposed within Newton County, upon the termination of the one percent sales and use tax for educational purposes presently in effect, for a maximum period of time of 20 calendar quarters, for the purposes of providing funds to pay (1) for the Newton District, (a) the costs of acquiring, constructing, and equipping safety and security upgrades to existing buildings and facilities; adding to, renovating, repairing, improving, and equipping existing school buildings, athletic facilities at existing high schools and middle schools, and other buildings and facilities useful or desirable in connection therewith; acquiring school buses, other vehicles, and related transportation equipment, safety and security equipment, and athletic, vocational, and fine arts equipment; acquiring instructional and administrative technology and communications improvements; acquiring land for future schools; and acquiring any necessary property therefor, both real and personal, all at a maximum cost of $112,300,000 (the "Newton Project"), and (b) the costs of retiring a portion of the Newton District's General Obligation Bond, Series 2018, or bonds issued by the Newton District to refund such bond, by paying or making provision for the payment of the principal of and interest on such bonds coming due on April 1, 2025 through April 1, 2030, in the maximum amount of $38,401,726; and (2) for the Social Circle District, the cost of adding to, renovating, repairing, improving, and equipping existing school buildings and other buildings and facilities useful or desirable in connection therewith; acquiring school buses and other vehicles, system-wide technology improvements, and fine arts equipment; and acquiring any necessary property therefor, both real and personal, all at a maximum cost of $300,000. The Newton New Bonds, if so authorized, shall be dated as of the first day of the month of delivery or such other date(s) as the Board of Education of Newton County (the "Newton Board") may approve, shall be in such denomination or denominations as the Newton Board may approve, shall bear interest from date at such rate or rates as the Newton Board may approve but not exceeding six percent (6.00%) per annum in any year, and shall provide for interest to be payable semiannually on April 1 and October 1 in each year, beginning on such April 1 or October 1 following delivery of the Newton New Bonds as the Newton Board may approve, and for principal to mature (by scheduled maturity or by mandatory redemption, as the Newton Board may approve) on the dates and in the amounts as follows: April 1 of the Year Amount 2026 $2,385,000 2027 $2,505,000 2028 $2,630,000 2029 $2,760,000 2030 $2,900,000 2031 $3,045,000 2032 $3,195,000 2033 $3,355,000 2034 $3,525,000 2035 $3,700,000 The Newton New Bonds may be issued in one or more series, and on one or more dates of issuance as the Newton Board may approve; provided, however, that the aggregate principal amount of the Newton New Bonds shall not exceed $30,000,000. The Newton New Bonds may be made subject to redemption prior to maturity, to the extent permitted by law, upon terms and conditions to be determined by the Newton Board. The several places for holding the election shall be in the regular and established precincts of Newton County, and the polls will be open from 7:00 a.m. to 7:00 p.m. on the date fixed for the election. Those qualified to vote at the election shall be determined in all respects in accordance and in conformity with the Constitution and statutes of the United States of America and of the State of Georgia. The last day to register to vote in this special election is April 22, 2024, through 5:00 p.m. Any brochures, listings, or other advertisements issued by the Newton Board or by any other person, firm, corporation, or association with the knowledge and consent of the Newton Board shall be deemed to be a statement of intention of the Newton Board concerning the use of the bond funds or interest received from such bond funds that have been invested.
